This Privacy Notice is intended to provide details regarding the information we collect and/or process through the website located at https://www.metrixiq.com/ or any successor website (the “Site”), and any applications, Sites, or online services that link to this Privacy Notice (collectively, the “Services”), or through other communication methods such as email or phone.
This Privacy Notice does not apply to websites, applications, or services that do not display or link to this webpage, are not operated by us, or that display or link to different privacy statements. If you are a parent or guardian (“Guardian”) of a childcare organization or government education or childcare entity using our Services (“Customers”), we may process some of your personal information provided through the Services we host or provide for such Customers. Customers may have their own privacy policies, which we encourage Guardians to review. Please see Third Party Sites and Applications below for details.
For purposes of this Privacy Notice, personal information means information relating directly or indirectly to an identifiable individual, except as may be set forth in applicable law.
PLEASE READ THIS PRIVACY NOTICE CAREFULLY TO UNDERSTAND HOW WE HANDLE YOUR PERSONAL INFORMATION. IF YOU DO NOT AGREE TO THIS PRIVACY NOTICE, PLEASE DO NOT ACCESS THE SITE, ENGAGE US FOR OUR SERVICES, OR OTHERWISE USE OUR SERVICES.
1. Personal Information Collected
We collect information about you as set forth below and through the means discussed below. Please note that we need certain types of information so that you can access our Services, or we can provide the Services you request. If you do not provide us with the required information, or ask us to delete it, you may no longer be able to access or use our Services.
While parts of the Services may not require you to provide any information that can directly identify you by name (such as simply browsing the Site), the specific types of information we collect will depend upon the Services you request or otherwise use and the information you choose to provide. The types of data we may collect include:
· Contact information such as first and last name and email address.
· Customer and transaction information such as information about purchases or other transactions with us and information about your customer service interactions with us.
· Work-related information such as employer and job title.
· Usage Data as defined below under Information We Collect Through Automated Means.
· Feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online, including chat transcripts, and contents of emails you send.
· Marketing information, such as your preferences for receiving communications about our activities, events, and publications, and details about how you engage with our communications.
· Banking and tax information if we are contracted to provide certain Services to you related to payment of fees to you or your organization.
In addition, if you are a Guardian, we may also collect the following about you or your child(ren):
· Contact information such as postal address and phone number.
· Financial information and sensitive details it contains, such as annual income bracket, gross annual income, tax returns, paystubs, unemployment records, or Supplemental Nutrition Assistance Program (SNAP) records, which such information may include social security number, income and compensation details, tax filing details, and name(s) of dependents.
· Household information, such as size of household and number of children in your household.
· Child information, such as the name, age, date of birth, race, sex, gender, or ethnicity of any children whose information you provide.
· Child documentation, such as birth certificate, hospital records, or baptismal records, which may also contain your personal information in addition to the child’s.
Sensitive Personal Information
MetrixIQ recognizes that certain jurisdictions have enacted laws with different requirements regarding the processing of certain sensitive personal information. When using the Site but not using our Services, MetrixIQ does not require Sensitive Personal Information from you. In the cases where we do seek to collect Sensitive Personal Information, for example when we conduct recruiting activities or when you are a Guardian using certain Services we provide to Customers, we will seek to do so in accordance with applicable data privacy laws. Do not provide us with unsolicited Sensitive Personal Information.
Personal Information You Provide to Us
We may collect information that you provide directly to us. For example, we may collect information from you through:
· The Services we provide, including if you are associated with a Customer or are a Guardian
· Your requests for information from us or from your other communications with us
· Requests for customer support or technical assistance with the Services
· Your attendance at webinars, conferences, and other online and offline events
Information We Collect Through Automated Means
When you use the Services, we collect and analyze some information via a variety of technologies that automatically or passively collect information about the Services, such as IP address, browser type(s), location (including IP address and latitude and longitude), browser language, operating system, referring and exit pages and URLs, error log data, and other similar information (“Usage Data”).

Information Obtained From Third Parties
We may receive personal information about you from third-party sources such as our Customers (who may be government entities such as school districts or departments of education), childcare organizations, marketing partners, social media and other cloud-based platforms, publicly available sources, data providers, or third-party staffing or personnel providers.
Recruiting and Candidate Information
If you choose to apply to work with or for MetrixIQ through our Site or by otherwise contacting us regarding opportunities to become an employee, agent, or contractor for us, we may collect the following:
· Contact information such as your first and last name, email and mailing addresses, phone number, professional title or profession, and company name if applicable.
· Application information regarding qualifications, skills, employment or education history, or other related information provided voluntarily in response to questions and during any interviews.
· Reference Information, such as name and contact details of your references.
· Social Media Information, such as if you provide us a link to or other access to a social media account, we may collect or access any information you permit to be shared through or from your social media account and other information depending on the social media platform.
· Background Check Information, subject to applicable law.
· Compensation information that you voluntarily provide, and which may depend on your region and applicable laws and regulations.
You are responsible for the personal information you provide or make available to us. All personal information you provide, particularly in connection with our recruiting activities, must be truthful, accurate and not misleading in any way. You may not provide information that is obscene, defamatory, infringing, malicious, or that violates any law. If you provide personal information of a third party, you are responsible for providing any notices and obtaining any consents necessary for us to collect and use such personal information as described in this Privacy Notice.
2. How We Use Your Personal Information
We, or our service providers working on our behalf, may use your personal information for various purposes depending on the types of information we have collected from you in order to:
· Develop, provide, deliver, and improve the Services. For example, your information is hosted and processed by our Services to create an account for you or your organization and to provide you access to our Services, such as managing applications from Guardians, receiving and paying childcare program fees, and displaying your childcare facility’s student roster. We may use such information you provide in identified, as well as in aggregated or deidentified, form, to refine and improve the Services such as to add new features and improve the user experience.
· Respond to your requests for information and provide you with more effective and efficient customer service and technical support. For example, we use your information to respond to your requests for information about our Services and, if you are associated with a Customer and submit a request for technical support, to identify you as associated with a current Customer, provide more accurate and personalized technical support, and to better understand your use of our Services and evaluate any support requests.
· Market, promote, and conduct advertising for the Services. For example, we use your information to send you marketing communications via email or other contact methods where permitted by applicable law.
· Maintain, secure, and improve current and future Services. For example, our Services may collect your information through forms that you submit and may collect information automatically about your use of the Services to inform us about Services performance, areas of improvement, and Services updates and changes we may decide to evaluate.
· Comply with any procedures, laws, and regulations which apply to us or our processing. For example, we comply with subpoenas and other court orders to process data where we have determined there is a legal requirement for us to do so.
· Establish, exercise, or defend our legal rights. We may process your personal information in connection with establishing, exercising, or defending our legal rights where it is necessary for our legitimate interests or the legitimate interests of others or for fraud prevention. For example, we may process information you provide to identify any fraudulent, harmful, unauthorized, unethical, or illegal activity such as use of another individual’s identity and we may use your information as necessary to defend ourselves in litigation or enforce our rights or agreements with others.
· Conduct recruiting and hiring activities for opportunities with MetrixIQ. If you apply to work with or for MetrixIQ, we will review the information you submit to determine if your qualifications and experience match any available opportunities at MetrixIQ, to verify the information you provide, communicate with you regarding any opportunities, improve our recruiting processes, process your onboarding if hired, and comply with applicable labor and employment laws.
· Other legitimate purposes as required or permitted by applicable law. We may process your information for other purposes consistent with those in this Privacy Notice and as may be permitted or required by applicable law.
In addition, if you are a Guardian, we may also use you or your child(ren)’s information as follows:
· To process your applications for financial support for childcare services you request from a Customer, as a part of the Services we provide to Customers.
· To communicate with you via email, phone, text, or otherwise regarding your financial support applications.
Aggregate/Deidentified Data
We may aggregate and/or deidentify any information collected through the Services so that the information can no longer be linked to you or your device. We may use the aggregated and/or deidentified information for any purpose, including without limitation for research purposes and to promote MetrixIQ’s products and Services, and may also disclose such data to any third parties, including advertisers, promotional partners, and sponsors.
Cookies and Similar Technologies
To collect the information in the “Information We Collect Through Automated Means” section above, we and our service providers may use internet server logs, cookies, and similar technologies. For more detailed information, please refer to our Cookie Notice.
3. How We Disclose Your Personal Information
MetrixIQ may disclose your personal information in the following ways:
· Service Providers: We disclose personal information with select third parties who perform services on our behalf. They have access to your information to perform these services but are prohibited from using your information for other purposes. They provide a variety of services to us, including network access, data storage and/or processing, software development billing, sales, product content and features, research, customer service, security, fraud prevention, payment processing, marketing and advertising, and legal services.
· Customers and the Government: Depending on your role and your relationship with us or our Customer, we may disclose your personal information to our Customer in order to fulfill the purpose for which you have provided your information and/or for which our Customer is using the Service. Our Customer may be a government entity such as a school district or department of education. Please contact the relevant Customer to learn whether your information has been or will be disclosed to that entity, what information may be disclose, and what disclosure choices you have. You may additionally contact us as set forth below with additional questions. If you do not want to disclose your information with Customers in this way, you should not use those features of the Services.
· Childcare Providers: Depending on your role and your relationship with us or our Customer, we may disclose, or enable you to disclose, your information to certain childcare providers who are contracted by our Customers (including governmental entities described above) to provide childcare services to eligible applicants, for purposes of determining your eligibility to enroll a child in publicly-available childcare programs, receive financial support for such programs, or receive other publicly-available childcare benefits. This disclosure of information may be required to perform certain Services. If you do not want to disclose your information with childcare providers in this way, you should not use those features of the Services.
· Protection of MetrixIQ and Others: We may disclose the information we collect and maintain about you if required to do so by law or in a good faith belief that such access, retention or disclosure is reasonably necessary to: (a) comply with legal process (e.g., a subpoena or court order); (b) enforce this Privacy Notice, or other contracts with you, including investigation of potential violations thereof; (c) respond to claims that any content violates the rights of third parties such as rights of privacy or intellectual property; (d) respond to your requests for customer service; and/or (e) protect the rights, property or personal safety of MetrixIQ, its agents and affiliates, its users and/or the public. This includes exchanging information with other companies and organizations for fraud protection, spam/malware prevention, and similar purposes.
· Partners: We may disclose your information to partners such as distribution or joint marketing partners pursuant to our agreements with those parties. For example, if we engage with a reseller or another company, we may disclose your information to such parties so they may contact you directly or if you participate in a webinar or trade show featuring, including, or related to MetrixIQ, we may disclose your information to other participants or vendors in connection with those events such as other companies featured in a webinar or sponsors of a trade show.
· Consent: We may disclose your information when we have your consent.
· Business Transfers: As we continue to develop our business, we may buy, merge, or partner with other companies. In such transactions, including in contemplation of such transactions, user information, such as information processed in accordance with this Privacy Notice, may be among the transferred assets. If such transfer is subject to additional mandatory restrictions under applicable laws, we will comply with such restrictions.
· Aggregate/Deidentified Information: From time to time, we may disclose aggregate/deidentified information about use of the Services, such as by publishing a report on usage trends. The disclosure of such data is unrestricted.
· Intracompany: We may disclose your information to our affiliates and subsidiaries to operate our business, for example, if we create a subsidiary to operate a related business, we may disclose your information to such subsidiaries.
4. Retention of Your Personal Information
We keep your information for no longer than necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected and used it, requirements of applicable laws, the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the resolution of any pending or threatened disputes, and enforcement of our agreements.
If you are a Customer or associated with a Customer, we may retain your personal information both during and after the time you are our customer, but we typically keep it no longer than needed. For example, we may retain contact information after you are a customer to maintain our internal financial or transactional records, to communicate with you about our relationship, or in cooperation with law enforcement agency requests. We may retain information collected automatically only while the account is active.
When we no longer require personal information, we will either delete or deidentify it or, if this is not possible, securely store it in accordance with this Privacy Notice and cease use of the personal information until deletion is possible. If we deidentify your personal information (so that it can no longer be associated with you and thus is no longer considered personal information under Relevant Laws), we may retain this information for longer periods.
5. How We Protect your Personal Information
MetrixIQ takes technical and organizational security measures to protect the information provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. Do not share your password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although we use measures to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures.
6. Children’s Privacy
The Services are intended for general audiences and not for children under the age of 18. If we become aware that we have inadvertently collected or received personal information from children under the age of 18 without valid parental consent, we will take reasonable steps to delete it as soon as possible. We do not knowingly process data of children under the age of 18 without parental consent.
7. Users Located Outside the United States
Our Services are hosted in and provided from the United States, the Services are designed only for individuals in the United States, your use of our Services is governed by United States law, and the Services may not be appropriate, applicable, or compliant with laws in other regions. If you are using the Site or Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our systems and facilities, and those of our third-party providers and recipients of information, are located. The data protection and other laws of the United States and other countries might be different than those in your country. By using Services, you consent to your information being transferred to our systems and facilities, and to the systems and facilities of those third parties to whom we disclose information, as described in this Privacy Notice.
8. Rights and Choices
Choosing Not to Provide Your Personal Information
You may choose not to provide personal information. If you choose not to provide personal information (or ask us to delete it), we may not be able to provide you with our Services or certain functionality of the Services. We will tell you what information you must provide to receive the Services’ functionality by designating it as required at the time of collection or through other appropriate means.
Marketing Communications
You may instruct us not to use your contact information to contact you by email, postal mail, or phone regarding Services, promotions, surveys, and special events that might appeal to your interests by following the instructions located at the bottom of any commercial emails you may receive, or by emailing us as set forth below. Please note that, regardless of your request, we may still use and disclose certain information as permitted by applicable law. For example, you may not opt out of certain operational or transactional emails, such as those reflecting our relationship or transactions with you, or important notifications regarding the Services we are providing to you or which our Customer requires us to send to you.

9. Text Message Terms
If you elect to receive text messages, we will send you text messages regarding status of the Service and security confirmations to the mobile number you provided even if your mobile number is registered on any state or federal Do Not Call list. If you do not agree to these Text Message Terms, do not sign up for text messages. You understand that you do not have to sign up for text messages in order to make any purchases, and your consent to this text message program is not a condition of any purchase with us. Your participation in this program is completely voluntary.
Your wireless carrier may assess certain fees or charges associated with your use of text messaging. We are not responsible for such fees. Your carrier may restrict or prohibit certain mobile features and certain mobile features may be incompatible with your carrier or mobile device. Our text message program applies only to mobile devices registered in the United States and with United States carriers. Please review your wireless carrier’s policies and contact them if you have any questions. You acknowledge that you are at least eighteen years of age and you have the consent of the wireless account holder to sign up for text messages and pay for any related fees. We may use an automatic dialing system or automated number selection system to send you text messages. Neither we nor the carriers are liable for any delays or failures in the receipt of any text messages. Delivery is subject to effective transmission from your network operator. You are responsible for updating your number with us and ensuring your account information is correct. Messages may be sent via SMS or MMS messaging. Text messages will be transactional in nature (in response to your use of our Services, for example).
You can cancel our text message alerts at any time by texting “STOP” in response to the text message you received, after which we will send a text message to confirm that you have been unsubscribed. After this exchange, you will no longer receive text messages from that particular number. If you want to receive our text alerts again, respond to the unsubscribe confirmation with START or change the phone number in your account and we will start sending text alerts to you again. If at any time you forget what keywords are supported, text “HELP” to the text message you received and you will receive instructions on how to use our service as well as how to unsubscribe. Please contact us as set for the below with any questions regarding our text messages.
10. Third-Party Sites and Applications
Our Services may provide links to or make available integrations with third-party websites or applications (“Third-Party Sites”). Such Third-Party Sites are outside our control and not covered by this Privacy Notice. MetrixIQ is not liable for any information, content, products, services, software, or other materials available on or through Third-Party Sites. The use of a Third-Party Site or any information or other content found on Third-Party Sites is subject to and governed by the terms and conditions of such Third-Party Sites. We encourage you to review the privacy notices posted on such Third-Party Sites.
When Customers use our Services, our provision of those Services may include our processing of your personal information. Depending on the nature of the particular Service used by a Customer, our Customer may collect your information and provide it to us or our systems may collect the information directly from you via the Customer’s website, which we may operate on behalf of the Customer as part of the Service. Our Customers’ websites, which for purposes of this Privacy Notice are Third-Party Sites, may have their own privacy policy. We do not control Third Party Websites’ privacy policies. If you have questions regarding the personal information practices of Third Party Sites, please contact these Third-Party Sites.
11. Changes to Our Privacy Notice
We reserve the right to amend this Privacy Notice at any time to reflect changes in the law, our data collection and use practices, our Services, advances in technology, and for other purposes. We will make the revised Privacy Notice accessible through the Services, so you should review the Privacy Notice periodically. The “Last Updated” date included at the end of this Privacy Notice will indicate when it was last updated. If we make a material change to the Notice, you will be provided with appropriate notice in accordance with legal requirements.
